Fundación Carmen Pardo-Valcarce, as data controller, sets out in this document the Corporate Privacy Policy on personal information that the data subject can provide in the context of any type of contractual or non-contractual relationship made. The objective of the Privacy Policy of the Carmen Pardo-Valcarce Foundation is to protect the information and data that the data subject can provide to it.

The Privacy Policy is chaired by compliance with current legislation on the protection of personal data: Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights; Organic Law 2/2006, of 3 May, on Education (LOE); and Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the Protection of Natural Persons with regard to the Processing of Personal Data and the Free Movement of Personal Data (GDPR).The use of the website alapar.ong implies acceptance of this Privacy Policy.

2. TREATMENT PURPOSES

At the Foundation we process the information provided to us by interested persons in order to offer and provide our services, and in particular to:

  • The management and development of the square in the corresponding service of the Foundation.
  • The management of the square in the school A la Par Niño Jesús del Remedio arranged with the Community of Madrid (hereinafter, the "Center").
  • The proper organization, provision and / or dissemination of the academic offer of the Center, its curricular activities, complementary and extracurricular activities and services of the educational center, as well as for communications with the student's family.
  • The academic, economic and administrative management of the Center, including the collection and processing of psychopedagic data and information related to the learning and socialization process of students generated during the school year.
  • The elaboration and development of the Individual Action Plans (hereinafter referred to as "PIA").
  • The administrative and formative management of the student's place in the CAMPVS formative project, the development of individualized attention to the interested party as well as, where appropriate, the management of financial aid to the study.
  • The proper organization and/or provision and/or dissemination of Fundaland's activities and services, as well as the correct communication with the parents or guardians of minors.
  • The proper organization and/or provision and/or dissemination of the academic offer of the Victim Care Unit with Intellectual Disabilities (hereinafter referred to as "UAVDI"), its activities and services, as well as academic, economic and administrative management.The correct execution of urban orchard leases.
  • The proper organization and/or provision and/or dissemination of employment office services consisting of job search and maintenance, job training, data and research analysis and the development of public and/or private projects.
  • The elaboration of a personalized proposal to provide the service.
  • The management and administration of direct debit orders related to the services provided by the Foundation.
  • The management of incidents, complaints and suggestions.
  • The collection and analysis of data for research purposes for the improvement of the service, in this case, preserving the identity of the data subject.
  • Periodic referral, by electronic means, SMS or push messaging, of information regarding the services and products offered, as well as information regarding offers and plans of third parties with which we have reached a commercial promotion agreement.

However, with regard to these commercial prospecting treatments the data subject may contact at any time, if deemed appropriate, to exercise his right of opposition to the processing and / or communication of the data for this purpose to offer you products and services through the email address proteccion.datos@alapar.ong or sending us a letter to the postal address with your request: C / Monasterio de las Huelgas no 15, 28049 Madrid, indicating your name, surname, ID and address. In the event that you have given us your unequivocal consent for this purpose, you may also revoke it at any time by the same means.

No automated decisions will be made or profiles will be developed with the data provided.

If the data provided for purposes other than those mentioned above are used, explicit and unequivocal consent will be requested for the specific purpose, informing all appropriate circumstances and legal considerations for this purpose.

3. PERIOD OF CONSERVATION OF YOUR DATA

The personal data provided by the data subject to the Foundation will be kept for five years from the end of the provision of the service. In cases where the legislation indicates longer periods as mandatory for the retention of some personal data, the retention period shall be that fixed by the corresponding law.

Where explicit consent is available for the use of personal data for commercial purposes, the data will be kept for 30 years.

The personal data and reports provided by the data subject to the Center, as well as others made during his stay in the Center will be kept for five years from the last confirmation of interest.

The minutes of the courses held at the Center and the title registration book will be historical.

4. LEGITIMATION FOR TREATMENT

The legal basis for the processing of the personal data of the data subject is as follows:

  • The performance of a service delivery contract agreed with the Foundation, in accordance with the terms and conditions contained in the agreed contractual documentation.
  • The legitimacy granted by the Organic Education Act 2006 (LOE) for the processing of data in the exercise of the educational function.
  • The development and execution of the legal relationship that occurs with the enrolment of the student in the Center.
  • The explicit and unequivocal consent given by the data subject, or his parents or guardians if they are under the age of 14, for the processing of their personal data by the Foundation.
  • The execution of the concert between the Community of Madrid and the Foundation for the management of the College of Special Education A la Par Niño Jesús del Remedio.
  • Legitimate interest in the development and implementation of IPAs.
  • Compliance with grants, contracts, concerts or framework agreements with the public administration or corresponding private entity.

5. COLLECTION OF PERSONAL DATA AND INFORMATION

The minimum necessary data collected by the controller will be as follows:

  • First and last name
  • DNI/NIE
  • Date of birth
  • E-mail
  • Address
  • Mobile contact phone
  • Parent/Guardian Data (in case of minors)
  • Bank details (in case of direct debit)
  • Other information you voluntarily provide to us

The data subjects guarantee the veracity of the personal data provided and undertake to communicate any update thereof.

Lack of consent or opposition to any of the data processing may make it impossible to provide you with the service you request from us.

The processing of personal data collected through or linked to the alapar.ong website (through the forms or questionnaires inserted on the website) also respects the GDPR requirements and the current regulations on the protection of personal data.

The Foundation will process the personal data collected through this website in compliance with current data protection regulations. Thus, the inclusion of data in forms is absolutely voluntary and duly announced, showing the relevant information clauses; the legitimacy of the processing of your data is the consent given by the user by sending the registration form, contact or consultation; the data will only be used for the purpose for which they have been collected; and all persons who provide data through the website and, in general, any interested party, have the rights recognized by the GDPR to access, rectify and delete the data, request the portability of the same, oppose the processing and request the limitation of the same.

6. RECIPIENTS OF YOUR DATA

The Foundation will not disclose personal information contained in its registration of processing activities to third parties without having the express consent of the interested party or where there is an enabling cause for it, except in the cases set out in the following paragraph.

The data will be communicated for the fulfillment of the processing purposes established in this Privacy Policy to the following entities:

  • The external entity responsible for the computer application for the management of clients and students, management of email, website, payroll and documentation related to human resources, as well as the management of occupational risk prevention of the Foundation.
  • The external insurance in charge of work accidents and occupational diseases of the Foundation.
  • The entity called ''Clikckedu'' for the computer processing of the Center's data.
  • Banks, companies of activities and / or services or the Association of Mothers, Parents and Pupils (AMPA), in order to carry out the activities that are their own, never for commercial purposes.
  • Therapeutic centers, entities or associations that intervene with the interested party because of the services provided by the Foundation.
  • Banks, savings banks, credit unions or public administrations related to the execution and management of direct debit orders.
  • Entities applying for candidates and/or contractors in relation to the services offered by the Employment Office.
  • The destination plant, in the case of plant transfer for the execution of the same service or in the case of plant transfer.
  • On visits, trips and activities outside the Center to entities that so require.
  • With the public administration or corresponding private entity when the service is subsidized, contracted, agreed, arranged or agreed with any external entity.
  • In addition, personal data, including those of a reserved nature, will be provided to the Public Administration, when required by the Public Administration in compliance with a legal obligation, as well as to the Security Forces, Social Services or Health Services, the Administration of Justice and the Tax Administration.

The controller has taken the necessary measures to maintain the required level of security, depending on the nature of the personal data processed and the circumstances of the processing, in order to avoid, as far as possible, its alteration, loss, treatment or unauthorized access.

9. MODIFICATION OF THE PRIVACY POLICY

This Privacy Policy may be modified, altered and/or replaced, at any time, as a result of possible legislative changes, jurisprudence, of the criteria followed by the AEPD and/or the competent authority at any time or according to the practices, uses and customs of the sector, as well as because of any changes unilaterally decided by the management of the controller.

In any case, the controller undertakes to provide, visibly, sufficient information about the modification that may be suffered by the Privacy Policy and we recommend that you review this policy through the means granted by the Foundation in order to be adequately informed.

10. APPLICABLE REGULATIONS

This Privacy Policy has been adapted to the new Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the Protection of Natural Persons with regard to the Processing of Personal Data and the Free Movement thereof, and is in accordance with the national implementing legislation materialised in Organic Law 15/1999 of 13 December, Protection of Personal Data (EU GDPR 2016/976), Royal Decree 1720/2007 of 21 December approving the Regulations on the Development of Organic Law 15/1999 (EU GDPR 2016/976) and Organic Law 2/2006 of 3 May on Education (LOE).
